Shipping & Delivery Policy

This Shipping & Delivery Policy explains how Simply Shoes ("Simply Shoes", "we", "us" or "our") handles the delivery of orders placed through our online store.

This policy applies to orders delivered within the United Kingdom.

Nothing in this policy limits or excludes any statutory rights you have under UK consumer law.


1. Where We Deliver

Simply Shoes currently delivers to addresses within the United Kingdom only.

We do not currently offer delivery outside the UK.

Delivery availability may depend on the specific address entered at checkout. If we are unable to deliver to an address, we will notify you as soon as reasonably possible.


2. Delivery Options

The delivery options available for your order, together with the applicable delivery charges and estimated delivery times, will be displayed at checkout before you place your order.

Available services may include standard and/or expedited delivery depending on your location and the options available to us at the time of purchase.

The delivery service you select at checkout forms part of your order.


3. Delivery Charges

The delivery charge applicable to your order will be clearly displayed before you complete your purchase.

Any applicable delivery charge will be added to the total amount payable at checkout.

We will not charge you additional delivery fees after your order has been placed unless:

  • You expressly request an additional delivery service; or

  • An additional charge is otherwise permitted by law and you have expressly agreed to it.

We will not use pre-selected options to obtain your consent to additional payments.


4. Estimated Delivery Times

Estimated delivery times will be displayed at checkout or otherwise communicated to you before your order is placed.

Unless a specific delivery date or period has been expressly agreed with you, we will deliver your order without undue delay and, in any event, within 30 days after the contract is entered into, subject to applicable law.

Where a specific delivery date or period has been agreed with you, we will use reasonable endeavours to deliver within that agreed period.

Delivery estimates are not intended to remove or reduce your statutory rights if we fail to deliver within the legally applicable timeframe.


5. Dispatch Times

We aim to process and dispatch orders promptly.

Orders will normally be dispatched within the timeframe stated on the Website or at checkout.

Dispatch means that the order has been handed to the delivery carrier. It does not necessarily mean that the order has been delivered.

During periods of unusually high demand, promotional events, public holidays or circumstances outside our reasonable control, dispatch may take longer than usual.

Where a delay becomes significant, we will take reasonable steps to keep you informed.


6. Delivery Address

You are responsible for providing a complete and accurate delivery address when placing your order.

Please check your:

  • House or building number;

  • Street name;

  • Town or city;

  • Postcode; and

  • Any relevant flat, apartment or unit number.

If you provide an incorrect or incomplete address, this may cause a delivery delay or prevent delivery.

If you realise that you have entered an incorrect address, please contact us as soon as possible.

We will make reasonable efforts to assist, but we cannot guarantee that an address can be changed once an order has been dispatched.


7. Delivery to a Third Party

You may provide a delivery address for another person, such as a family member or another person at your address.

You remain responsible for ensuring that the delivery information supplied to us is accurate.

Where you nominate another person to receive your order at the delivery address, delivery to that person may constitute delivery to you.

This does not affect your statutory rights where goods have not actually been delivered as required by law.


8. Tracking

Where a tracked delivery service is used, we will provide tracking information where reasonably available.

Tracking information is provided to help you monitor the progress of your delivery.

A tracking status showing that a parcel has been delivered will not by itself remove your statutory rights if you have not actually received the goods.

If your tracking information says that your parcel has been delivered but you have not received it, please contact us as soon as possible.


9. Risk in the Goods

For consumer purchases, the risk of loss or damage to the goods remains with Simply Shoes until the goods come into your physical possession, or the physical possession of a person you have identified to receive them on your behalf, other than a carrier you selected independently where applicable law permits risk to pass earlier.

This means that Simply Shoes will not simply treat an order as your responsibility because a delivery carrier has collected it from us.

If your parcel is lost, damaged or incorrectly delivered before you take possession of it, please contact us so that we can investigate and take appropriate action.


10. Delayed Deliveries

We will make reasonable efforts to deliver your order within the estimated delivery period.

However, delivery times may occasionally be affected by circumstances outside our reasonable control, including:

  • Severe weather;

  • Flooding;

  • Fire;

  • Industrial action;

  • Major transport disruption;

  • Network or infrastructure failures;

  • Government restrictions;

  • Security incidents;

  • Natural disasters; or

  • Other events beyond our reasonable control.

Where such an event causes a delay, we will take reasonable steps to minimise the effect of the delay and keep you informed where appropriate.

A delay does not automatically remove your legal rights.


11. Delivery Delays That Are Our Responsibility

If we fail to deliver within an agreed delivery period, or otherwise fail to meet our legal obligations concerning delivery, you may have statutory rights to require delivery within an additional appropriate period and, in certain circumstances, cancel the contract and receive a refund.

You may have stronger rights where:

  • We refuse to deliver the goods;

  • Delivery by a particular date was essential and you made this clear before entering into the contract; or

  • The circumstances mean that delivery within the agreed period was essential.

Where you have a legal right to cancel because of our failure to deliver, we will provide the applicable refund in accordance with the law.

We will not use this policy to exclude or restrict those rights.


12. Lost Parcels

If your order has not arrived within the expected delivery period, please contact us.

We may ask you to confirm your delivery address and provide any relevant information required to investigate the delivery.

Where appropriate, we will contact the delivery carrier and investigate the missing parcel.

We will not require you to deal with the delivery carrier yourself as a condition of exercising your statutory rights against Simply Shoes.

If the goods have not been delivered and we are responsible for the loss, we will provide the remedy required by law.


13. Damaged Parcels

If your parcel arrives visibly damaged, please inspect the packaging and goods as soon as reasonably possible.

If the shoes themselves are damaged, please contact us and provide photographs where possible.

Photographs may help us investigate the issue with the carrier, but we will not make the provision of photographs an unlawful condition of exercising your statutory rights.

If the goods are damaged or faulty, we will deal with the matter in accordance with your statutory rights.


14. Incorrect Items

If you receive a different product, size, colour or style from the one you ordered, please contact us as soon as possible.

We will investigate the error and arrange an appropriate remedy.

Where we have sent you an incorrect item, you will not be responsible for the reasonable return costs that we are legally required to cover.

We will not treat an incorrect item as an ordinary change-of-mind return.


15. Orders Containing Multiple Items

Where an order contains multiple Products, we may send the Products together or separately depending on availability and operational requirements.

If we dispatch Products separately, you will not be charged additional delivery fees unless you expressly agreed to an additional delivery service.

Where a Product is unavailable and we cannot fulfil it, we will contact you and provide the appropriate remedy, including a refund where applicable.


16. Delivery Attempts

If the delivery carrier attempts delivery but cannot complete it because nobody is available to receive the parcel, the carrier may leave the parcel in a safe place, with a neighbour, at a collection point or arrange another delivery attempt, depending on the service selected and the carrier's procedures.

You should follow any instructions provided by the carrier.

If you have specifically provided instructions concerning delivery, we will pass those instructions to the carrier where reasonably possible.

However, we cannot guarantee that a carrier will follow delivery instructions that are outside the service they offer.

Nothing in this section removes our responsibility for ensuring that goods are delivered in accordance with applicable law.


17. Safe Places

If you provide instructions authorising a parcel to be left in a particular safe place, you acknowledge that this may increase the risk of theft or damage after the carrier has followed your instructions.

Where applicable law permits risk to pass following delivery in accordance with your instructions, Simply Shoes will not be responsible for subsequent loss or damage caused after that point.

However, this provision does not remove any responsibility that cannot legally be excluded.


18. Orders Not Collected From a Collection Point

If you choose a delivery service that requires collection from a designated collection point and you do not collect the parcel within the carrier's collection period, the parcel may be returned to us.

If this happens, please contact us.

Where the failure to collect was your responsibility, we may need to recover reasonable additional delivery costs before arranging another delivery, where legally permitted and where those costs were not caused by our breach of contract.

Your statutory rights remain unaffected.


19. Incorrect Delivery Information

If an order cannot be delivered because you supplied an incorrect or incomplete delivery address, please contact us as soon as possible.

We will make reasonable efforts to help resolve the situation.

If the parcel is returned to us, we may arrange another delivery where appropriate.

Where additional delivery costs arise solely because incorrect information was supplied by you, we may ask you to pay reasonable additional costs where permitted by law.

We will not charge unreasonable or disproportionate fees.


20. Delivery to a Carrier Chosen Independently by You

If you independently arrange for a carrier to collect your order rather than selecting a delivery option offered by Simply Shoes, different rules concerning risk may apply.

Where permitted by law, risk may pass to you when the goods are delivered to the carrier you independently selected.

This provision does not apply where you selected one of the delivery services offered by Simply Shoes.


21. International Delivery

Simply Shoes currently does not offer international delivery.

Orders will only be accepted for delivery within the United Kingdom.

If this changes in the future, we will publish a separate international shipping policy and provide any legally required information concerning international delivery, customs, duties and taxes before orders are placed.


22. Delivery and Your Cancellation Rights

Delivery of your order does not affect your statutory right to cancel an online purchase where that right applies.

Our separate Returns, Refunds & Cancellation Policy explains the procedure for cancelling and returning an order.

For a standard change-of-mind cancellation, the customer is generally responsible for the direct cost of returning the goods to Simply Shoes, provided we have given the required information about those costs before the contract was made.

This does not apply where we are legally responsible for the return cost, including appropriate cases involving faulty, damaged or incorrect goods.


23. Delivery Charges and Refunds

Where you validly cancel an online order under your statutory cancellation rights, we will refund the delivery charge that the law requires us to refund.

This generally includes the cost of the least expensive standard delivery option we offered.

If you chose a more expensive delivery service, we are not generally required to refund the additional amount above the cost of our standard delivery option.

Return postage for an ordinary change-of-mind return remains the customer's responsibility where applicable.


24. No Waiver of Statutory Rights

Nothing in this Shipping & Delivery Policy is intended to exclude, restrict or remove your statutory rights.

In particular, we do not exclude or limit our responsibility for:

  • Failing to deliver goods as required by law;

  • Faulty goods;

  • Goods that are not as described;

  • Goods that are not of satisfactory quality;

  • Goods that are not fit for purpose;

  • Loss or damage for which we are legally responsible; or

  • Any other liability that cannot lawfully be excluded.

UK consumer contract terms must be fair and transparent, and terms attempting to avoid responsibility for faulty or misdescribed goods may not be enforceable.


25. Changes to This Shipping Policy

We may update this Shipping & Delivery Policy from time to time.

The version applicable to your order will generally be the version in force when you place your order.

Changes made after an order has been placed will not retrospectively alter the contractual terms applicable to that order unless permitted by law or agreed with you.

27. Governing Law

This Shipping & Delivery Policy is governed by the laws of England and Wales, subject to any mandatory consumer protection rights that apply to you.

If you are a consumer, nothing in this policy prevents you from relying on mandatory protections available to you under the law applicable to your circumstances.
